Scope: The Hungarian Annex acts as a supplement to both the Platform Agreement and Ticket Agreement. The Hungarian Annex only applies to Sellers situated in Hungary and Buyers purchasing e-tickets from such Sellers via TicketSwap Local. The provisions of the Hungarian Annex supersede and have preference over the provisions as stated in the Platform and Ticket Agreement in case of conflicts between said provisions. Furthermore, certain provisions in the Platform and Ticket Agreement may not apply due to the difference in nature of the services provided by TicketSwap Local.
Seller: For the purposes of this Annex, a Seller is the person selling a ticket to TicketSwap Local via the Platform.
Buyer: For the purposes of this Annex, a Buyer is the person buying a ticket from TicketSwap Local via the Platform.
TicketSwap Local: TicketSwap Local buys e-tickets directly from Sellers situated in Hungary and sells those e-tickets directly to Buyers via its Platform. TicketSwap Local does not act as an intermediary between the Sellers and Buyers and only acts on its own behalf when buying or selling tickets. Sellers and Buyers enter into the Platform and Ticket Agreement separately with TicketSwap Local when purchasing or selling e-tickets from or to TicketSwap Local.
Miscellaneous: Other provisions such as (but not limited to) the exemption of liability of TicketSwap Local, the Privacy statement and applicable law as stated in the Platform and Ticket Agreement continue to apply.

Selling of e-tickets by Seller
Buying e-tickets by TicketSwap Local: TicketSwap Local buys e-tickets directly from Sellers situated in Hungary via its Platform. The Seller makes an offer to TicketSwap local via its Platform to sell e-tickets to TicketSwap Local. TicketSwap Local subsequently puts a conditional offer on its Platform for the purchase of those e-tickets by a Buyer. TicketSwap Local may accept such an offer from the Seller at the moment a Buyer has accepted the conditional offer of TicketSwap Local. A purchase agreement between TicketSwap Local and the Seller is only entered into at the moment the Buyer has irrevocably accepted TicketSwap Local’s offer.
Obligations of TicketSwap Local: TicketSwap Local has an obligation to pay the Seller the Price for the e-tickets as offered by the Seller, in case TicketSwap Local accepted the offer of the Seller. Seller may only exercise its contractual rights versus TicketSwap Local, but not versus any subsequent Buyer of the e-tickets.
Price: The Seller determines the selling price. The selling price of the e-tickets offered by the Seller to TicketSwap Local is displayed on the Platform. Payment and delivery: TicketSwap Local has a payment obligation to the Seller and the Seller has an obligation to deliver the e-ticket to TicketSwap Local. TicketSwap Local pays the Seller via its Platform using available payment methods accepted by the Seller. The Seller delivers the e-ticket to TicketSwap Local via its Platform.
Guarantee: The Seller guarantees to TicketSwap Local that e-tickets offered by the Seller are usable for re-sale by TicketSwap Local. The Seller confirms that the e-tickets are valid and can be used for the event for which the e-tickets were distributed. The Seller is liable for any damage caused to TicketSwap Local by Seller in case of breach of this guarantee. This includes (but is not limited to) any claims by Buyers to TicketSwap Local for breach of contract caused by the Seller’s breach of this guarantee.
Buying of e-tickets by Buyer
Selling of e-tickets by TicketSwap Local: TicketSwap Local sells e-tickets directly to Buyers via its Platform. TicketSwap Local puts a conditional offer on its Platform for the purchase of e-tickets by a Buyer. A purchase agreement between TicketSwap Local and the Buyer is only entered into at the moment the Buyer has irrevocably accepted TicketSwap Local’s offer and TicketSwap Local subsequently accepts the offer of the Seller.
Obligations of TicketSwap Local: TicketSwap Local has an obligation to deliver the e-ticket to the Buyer. Buyer may only exercise its contractual rights versus TicketSwap Local, but not the Seller.
Price: TicketSwap Local determines the selling price of each e-ticket that she offers to the Buyer, but bases this on the price for which TicketSwap has purchased the Ticket from Seller and adds a margin of 5%. TicketSwap Local charges VAT in accordance with applicable VAT legislation. Buyer is informed of the total selling price of the e-ticket at the moment of buying the e-ticket. This information is also included on the proof of purchase. TicketSwap Local does not charge Service Fees.
Payment and delivery: The Buyer has a payment obligation to TicketSwap Local. The Buyer of an e-ticket can pay online via the offered payment methods. After purchase, the e-ticket is immediately downloadable from the Platform. In addition, as soon as possible after payment is received, TicketSwap Local provides the e-ticket i.) in My Purchases in your TicketSwap account and ii.) per email in the form of a link to the PDF file.
Conformity: TicketSwap Local is required to deliver a conform product, i.e. the e-ticket, in accordance with applicable law to the Buyer. The Buyer is hereby informed of the fact that TicketSwap Local is not the organizer of the event for which the Buyer purchases an e-ticket. TicketSwap Local cannot be held accountable for cancellations of events.
Cancellation by Buyer: The Buyer does not have the right to cancel his or her purchase of an e-ticket from TicketSwap Local.
Cancellation by TicketSwap Local: TicketSwap Local has the right to cancel its sale of an e-ticket to a Buyer, but only if the Seller is not able to comply with its contractual obligation to deliver the relevant e-ticket to TicketSwap Local.
